Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Aluy CLI (the "Software", a code harness) and the website at aluy.dev (the "Site"), provided by Hiperplano Ltda ("we", "us"). By downloading, installing or using the Software or the Site, you agree to these Terms. If you do not agree, do not use them.

1. Purpose & nature of the project

The Aluy CLI was created for educational, non-profit purposes and is offered for free use. Anyone, including companies, may adopt it for corporate use, provided that the project’s maintainers and contributors are not held liable for its use under any circumstances whatsoever.

Access to the technology is free of charge: there is not, and there will not be, any charge or indirect charge for costs related to the use of the technology. The use, modification, manipulation and redistribution of the Software are freely permitted, provided they are duly and explicitly attributed, including a mention of the original creator of the project and of this site.

2. Open-source software & license

The Aluy CLI is open-source software distributed under the MIT License. The MIT License governs your rights to the source code; these Terms govern your use of the Software and the Site. Where the two conflict regarding the code itself, the MIT License prevails.

3. Beta software

The Software is provided in beta. It may contain errors, change substantially, or be suspended or discontinued at any time, with or without notice. Features may not work as described.

4. "As is" — no warranty

THE SOFTWARE AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Software will be error-free, secure or uninterrupted, that defects will be corrected, or that it will not result in data loss, corruption or unintended actions.

5. It runs on your machine — your responsibility

The Aluy CLI is an autonomous agent that, with the permissions you grant, reads and edits files and runs commands on your machine — and, if you enable modes such as --yolo, it may do so without asking for each action. You are solely responsible for:

• reviewing and approving the actions the agent takes, and the permissions and level of autonomy you grant it;
• maintaining backups of your data and code;
• any outcome, including data loss, file corruption, unintended or destructive commands, and costs incurred;
• not running it as a privileged user or against critical/production systems unless you accept the risk.

You use the Software at your own risk.

6. Third-party providers, credentials & your data

The Software connects to third-party model providers (e.g., OpenAI, Anthropic, Google, DeepSeek, OpenRouter), MCP servers and other services that you choose to enable, using your own accounts and credentials. Your use of those services is governed by their own terms and privacy policies; we are not responsible for them, for what they do with data you send them, for their availability, or for any charges they bill you. You are responsible for ensuring you are authorized to send any data you submit through the Software.

7. Privacy & data security

The Aluy CLI runs locally: your session, history, files, memory and provider keys remain on your machine, and only the model call crosses the edge. We do not collect your code or files, and the Site does not collect personal data. We cannot, however, guarantee that data will never be lost, intercepted, exposed or leaked, whether due to the Software, the providers you connect, your environment, or third parties. To the maximum extent permitted by law, we disclaim any liability for such events.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIPERPLANO LTDA, ITS CONTRIBUTORS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, NOR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SOFTWARE OR THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify, defend and hold harmless Hiperplano Ltda and its contributors from and against any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the Software, your violation of these Terms, or your violation of any law or third-party right.

10. Acceptable use

You agree not to use the Software for any unlawful purpose, to infringe third-party rights, or in any way that violates applicable law.

11. No professional advice

Output produced by the Software (code, suggestions, automations) may be inaccurate or incomplete and must be reviewed by you before use. It does not constitute professional, legal, financial, security or other advice.

12. Changes to these Terms

We may update these Terms at any time. The "last updated" date above reflects the current version; continued use after changes means you accept them.

13. Governing law

The Aluy CLI and these Terms comply with the applicable laws in force.
